Spam Vs Freedom Of Speech – Who Wins?

The story goes something like this:

  • An experienced web user receives email spam from “Cruise. com”
  • The victim is able to trace where the email comes from and makes a phone call to the spammers, he then tells them to don’t send more mails and the spammer (aka John Lawless) agrees
  • Next day the victim receives more spam and in anger he posts photos of the spammers on his website, along with the word “spammers”
  • The people behind Cruise sue the victim for besmirching their reputations, and the victim also sues the spammers for violations under state and federal antispam laws

Who do you think wins the battle in the courts?

The trial judge dismissed the victims suit, ruling that the e-deals weren’t misleading enough to be spam.

The victim faces the possibility of owing $3.8 million in damages for speaking his mind.

Receiving unsolicited email that contain stupid offers isn’t considered spam? Hmmm…
